- This kind of contract involves the exercise of skill and labour by one party on some goods or materials supplied by another party or supplied by a party who exercise skill and labour for price.
- It is immaterial as to who supplies the material. Alternatively, it can be said that in this kind of contract, the main purpose is to exercise work and skill.
- The intention of parties is to transfer goods only after exercise of some skill and labour.
The best example of this is the dentist.
The dentist agrees to supply a set of artificial teeth to the patient. The materials arranged by the doctor only. Hence it is a contract for the sale of goods.
